Terms of Service

Please read these Terms of Service carefully before using the SmileLink website and related services. By accessing or using SmileLink, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Interpretation and Definitions

In these Terms, capitalized words have the meanings described in this section, whether used in singular or plural form.

“SmileLink,” “Company,” “we,” “us,” or “our” means SmileLink, Ljubiše Miodragovića 55, Belgrade, Serbia.

“Service” means the SmileLink website, accessible at https://smilelink.co, and any related features, tools, messaging, forms, and communication channels provided by SmileLink.

“User,” “you,” or “your” means any person who accesses or uses the Service, including patients and clinic representatives.

“Clinic” means a dental clinic, dental practice, dental professional, or clinic representative that creates an account or is listed on the Service.

“Patient” means a person who uses the Service to inquire about dental services, request information, or communicate with Clinics.

“Content” means any text, photos, videos, treatment descriptions, pricing information, clinic profile information, reviews, ratings, documents, messages, and other materials submitted to, displayed on, or transmitted through the Service.

“SmileLink Marks” means SmileLink’s name, logo, trademarks, service marks, trade dress, designs, visual interfaces, brand features, platform layout, graphics, icons, color schemes, and any other branding elements associated with SmileLink.

2. SmileLink’s Role

SmileLink is a technology, marketing, and communication platform that helps Patients discover Clinics and helps Clinics receive inquiries from Patients. SmileLink facilitates introductions, information exchange, and communication between Patients and Clinics.

SmileLink is not a healthcare provider, does not provide medical or dental care, and is not a broker of medical services. SmileLink does not diagnose, recommend treatments, set medical prices, influence clinical decisions, or participate in treatment planning. All clinical decisions are made solely by the Clinic and the Patient.

3. Medical Disclaimer, No Guarantee of Treatment Outcomes, and No Clinical Responsibility

All medical information, treatment plans, price quotations, timelines, clinical recommendations, and expected outcomes are provided solely by Clinics. SmileLink does not verify medical suitability, does not guarantee outcomes, and does not ensure that any treatment is appropriate for a specific Patient.

SmileLink makes no guarantees of any kind regarding the success, quality, safety, durability, aesthetics, or long term performance of any dental treatment provided by a Clinic. By using the Service and accepting these Terms, you understand and acknowledge that treatment outcomes vary between individuals and that no result is promised or assured by SmileLink.

Dental treatments may carry inherent risks, including complications, dissatisfaction with outcomes, and the need for additional procedures or follow up care. You acknowledge that SmileLink bears no responsibility for clinical outcomes, complications, dissatisfaction, refunds, rework, or follow up care, whether arising before, during, or after treatment.

If you have concerns about your dental health, you should consult a licensed dental professional. In an emergency, contact local emergency services immediately.

4. Eligibility, Accounts, and Minors

The Service is intended for adults. If you are under 18, you may use SmileLink only through a parent or legal guardian who uses the Service on your behalf and who accepts these Terms.

You agree to provide accurate account and contact information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Patient Obligations and Truthful Information

Patients agree to provide accurate and complete information to the extent necessary for Clinics to respond to inquiries, including contact information, relevant medical history, and documentation when requested by a Clinic. Patients acknowledge that Clinics may rely on the information provided when discussing treatment options.

SmileLink is not responsible for issues caused by incomplete, inaccurate, or misleading Patient disclosures, including situations where a Clinic’s guidance or estimate changes due to updated information or clinical findings.

6. Clinic Eligibility, Responsibilities, and Platform Integrity

Clinics using SmileLink represent and warrant that they hold all required licenses, registrations, and professional authorizations necessary to provide dental services in their jurisdiction, and that they comply with applicable laws, regulations, and professional standards.

Clinics are solely responsible for the accuracy of their profiles, credentials, treatment descriptions, pricing statements, timelines, and any medical or marketing claims they make. Clinics are solely responsible for patient care, clinical documentation, consent, aftercare, and compliance obligations that apply to healthcare providers.

SmileLink may suspend, restrict, or remove a Clinic listing or account if the Clinic misrepresents services, violates laws or professional obligations, breaches these Terms, or receives substantiated complaints. SmileLink may take these actions to protect Patients, preserve platform trust, and protect the reputation of the Service.

7. Pricing Transparency and Offers

Any price estimates, ranges, or indicative offers displayed on the Service are informational only unless a Clinic explicitly states in writing that a price is fixed and binding. Final pricing may change after an in person examination, imaging, laboratory evaluation, updated treatment planning, or other clinically necessary steps determined by the Clinic.

Patients acknowledge that travel, accommodation, and non clinical expenses are outside the scope of SmileLink and may vary. SmileLink is not responsible for pricing changes, additional costs, or billing disputes between Patients and Clinics.

8. Commission Model, Attribution, and Reporting

SmileLink operates on a commission based model with Clinics. Unless otherwise agreed in writing, SmileLink earns a commission equal to fifteen percent of the value of qualifying dental treatments completed by a Patient who was introduced to a Clinic through the Service.

A Patient is considered introduced through SmileLink if the Patient submitted an inquiry through the Service, used SmileLink messaging, used a SmileLink tracked contact mechanism, or otherwise interacted with a Clinic through a SmileLink generated lead record.

Clinics agree to accurately report completed treatments attributable to SmileLink introductions and to provide reasonable supporting information upon request, such as anonymized invoice references, treatment completion confirmation, or other documentation sufficient to confirm attribution, subject to applicable law and confidentiality obligations.

If a dispute arises regarding whether a Patient came through SmileLink or whether a treatment qualifies for commission, the parties will act in good faith to resolve the dispute. SmileLink may use lead records, timestamps, message logs, and referral tracking data to support attribution. SmileLink may also request additional confirmation from the Clinic, provided that any requested information is limited to what is necessary and lawful.

SmileLink may suspend a Clinic account for repeated non reporting, refusal to reasonably cooperate in attribution verification, or material breach of commission obligations. Any suspension does not waive the Clinic’s obligation to pay earned commission.

9. No Guarantee of Leads or Results

SmileLink does not guarantee patient volume, revenue, conversion rates, treatment acceptance, clinical utilization, or any commercial result. Clinics receive exposure and access to inquiries, not guaranteed outcomes. Patients acknowledge that SmileLink does not guarantee Clinic availability, appointment acceptance, or treatment eligibility.

10. Data Use and Consent, Privacy Policy

Your use of the Service is subject to the SmileLink Privacy Policy. By using the Service, you acknowledge that SmileLink will process personal data as described in the Privacy Policy, including processing necessary to operate the platform and share Patient submitted information with Clinics selected or matched through the Service.

You acknowledge that communications may occur through SmileLink systems and that SmileLink may retain communication records for platform security, quality, dispute resolution, and compliance purposes, as described in the Privacy Policy.

11. Cross Border Treatment Acknowledgment

SmileLink may facilitate connections for treatments that take place in a country different from the Patient’s country of residence. Patients acknowledge that cross border dental care may involve different legal standards, healthcare regulations, professional rules, pricing practices, and consumer protection frameworks.

Patients acknowledge that legal remedies, complaint mechanisms, and enforcement options may differ across jurisdictions, and SmileLink is not responsible for differences in legal rights or regulatory systems between countries.

12. Intellectual Property, SmileLink Branding, and Use Restrictions

The Service, including its software, code, user interface, design, layout, workflows, features, and all SmileLink Marks, is owned by SmileLink or its licensors and is protected by intellectual property laws.

Except as expressly permitted in writing by SmileLink, you may not copy, reproduce, modify, create derivative works from, distribute, sell, license, reverse engineer, scrape, mirror, frame, publicly display, or otherwise exploit the Service or any SmileLink Marks. You may not use the SmileLink Marks in any marketing, advertising, press release, domain name, social media handle, or promotional material without SmileLink’s prior written permission.

Clinics may display their listing on SmileLink as part of the Service and may state factually that they are listed on SmileLink, provided they do not imply endorsement, certification, partnership, or guaranteed results by SmileLink.

13. Content Ownership and License

Clinics and Users retain ownership of the Content they submit, to the extent they have lawful rights to that Content. By submitting Content to SmileLink, you grant SmileLink a worldwide, non exclusive, royalty free license to host, store, reproduce, display, publish, distribute, translate, adapt for formatting, and promote that Content for the purpose of operating, marketing, and improving the Service.

Clinics represent and warrant that they have all rights and permissions required to submit Content, including rights to use images, branding, and any patient related materials. Clinics must not upload patient images or identifiable health information without valid consent and a lawful basis.

SmileLink may remove Content that violates these Terms, applicable law, or platform integrity standards.

14. Prohibited Use

You agree not to misuse the Service. Misuse includes attempting unauthorized access, interfering with platform operation, submitting false information, scraping without permission, using the Service to harass others, posting unlawful content, or using SmileLink in a way that creates legal or reputational harm to the platform.

15. Termination and Suspension

SmileLink may suspend or terminate access to the Service immediately, without prior notice, if it reasonably believes a User has violated these Terms, engaged in fraud, misrepresented information, compromised platform security, or caused reputational harm to the Service.

Termination or suspension does not eliminate obligations that by their nature should survive, including commission obligations, indemnification obligations, and limitations of liability.

16. Limitation of Liability

To the maximum extent permitted by applicable law, SmileLink is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, travel costs, accommodation costs, missed appointments, treatment outcomes, follow up care costs, or any disputes between Patients and Clinics.

To the maximum extent permitted by applicable law, SmileLink’s total liability for any claim arising out of or related to the Service is limited to the amount actually paid by you to SmileLink through the Service in the twelve months preceding the event giving rise to the claim, or one hundred United States dollars if you have not paid SmileLink.

Nothing in these Terms limits liability where liability cannot be limited under applicable law.

17. Indemnification

Clinics agree to indemnify and hold harmless SmileLink from and against claims, damages, liabilities, losses, and expenses arising from or related to the Clinic’s services, clinical outcomes, medical advice, licensing status, advertising claims, pricing conduct, or legal compliance.

Users agree to indemnify SmileLink from and against claims arising from unlawful use of the Service, violations of these Terms, or submission of Content that infringes the rights of others.

18. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. SmileLink disclaims all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non infringement. SmileLink does not warrant uninterrupted operation, error free performance, or that any content is accurate or complete.

19. Dispute Resolution

If you have a dispute or concern, you agree to first attempt to resolve it informally by contacting SmileLink at [email protected]. If the dispute is not resolved, the parties agree that disputes arising out of or relating to these Terms will be submitted to the competent courts in Belgrade, Serbia, unless mandatory consumer protection rules require otherwise.

SmileLink may, at its discretion, offer mediation as a voluntary step before litigation.

20. Governing Law

These Terms are governed by the laws of Serbia, excluding conflict of law rules, unless mandatory consumer protection rules require application of another law.

21. Changes to These Terms

SmileLink may modify these Terms from time to time to reflect changes in features, platform operations, pricing models, legal requirements, or policies. If a change is material, SmileLink will make reasonable efforts to provide notice before the change takes effect. By continuing to use the Service after updated Terms become effective, you agree to the updated Terms.
